This Terms of Service Agreement (referred to as the "Agreement") is between you and Brightonbeautysupply.com and governs your use of service provided by Brightonbeautysupply.com
Sometimes in this Agreement Brightonbeautysupply.com will be referred to as "BBS" or "Us". The "BBS Service", sometimes referred to as just the "Service", means the service provided through the web site located at www.brightonbeautysupply.com.
Please read this Agreement carefully before using any aspect of the BBS Service.
By using the BBS Service you agree to comply with the terms of this Agreement. If you do not agree to this Agreement, do not use the BBS Service. We do not discriminate on the basis of age, race, national origin, gender, sexual orientation or religion.
Changes to this Agreement
You agree that we may change the terms and conditions in this Agreement at any time. We will always post the date of the latest version of the Agreement at the top of this Agreement. You agree that we may change the BBS Service or remove the BBS Service at any time in our sole discretion, for any reason or no reason and with or without notice to you. You agree that if you continue to use the BBS Service after we have posted a change to this Agreement, then you are bound by the most recent version of this Agreement. In other words, your continued use of the BBS Service means that you agree to be bound by the most current version of this Agreement.
We own the BBS Service
You agree that the BBS Service, including, but not limited to the Web Site and the Software, is owned by us. That means that as between you and us, you acknowledge that we own, or we license from other companies, any copyrights, trademarks, technology, patents in and to the Service and that you will not make any claim to any ownership in the Service (or any part of the Service).
Creating profiles and registering with the BBS Service
You do not need to register with BBS or create a profile to use the BBS Service. However, to take advantage of some of BBS features you may need to register with BBS and create a profile. If you do register with BBS and create a profile, you will be required to provide certain information which may include your first and last name, your email address and your zip code. You may also be asked to supply other information and/or create a profile which, though not required, may be helpful to other users of the BBS Service in learning more about you. BBS is committed to protecting your privacy online. We do not and will not sell, transfer or barter your personal information to any individual or company. We strictly use consumer information for the sole purpose of processing orders, providing order status, and providing promotional information. BBS may also terminate or cancel your account or profile, without any notice to you, for any reason in its sole discretion. You are solely responsible for maintaining the confidentiality of your password. You are also solely responsible for all activities that occur under your account. Any account name and password assigned to you by BBS, and/or accepted by BBS from you, for your access to the BBS Service shall be for your personal use only. You agree to immediately notify BBS of any unauthorized use of your account or password. BBS reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
Risk of Loss
When an order is placed, it will be shipping to an address designated by the purchaser as long as that shipping address is compliant with the shipping restrictions contained on this Web Site. All purchases from this Web Site are made pursuant to a shipment contract. As a result, risk of loss and title for items purchased from this Web Site pass to you upon delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.
Disclaimer of warranty and limits on our liability
THE BBS SERVICE, ANY INFORMATION AND ANYTHING ELSE RELATING TO THE BBS SERVICE, ARE PROVIDED BY BBS "AS IS" AND YOU USE THEM AT YOUR SOLE RISK. ALL EXPRESS, IMPLIED, STATUTORY AND OTHER WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS, ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. BBS IS ALSO NOT RESPONSIBLE FOR, AND DISCLAIMS, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY WARRANTIES FOR THE SECURITY, RELIABILITY, ACCURACY, TIMELINESS, AND/OR PERFORMANCE. YOU UNDERSTAND AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM YOUR ACCESS OF THE BBS SERVICE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY WHETHER IN ACTION OF CONTRACT OR NEGLIGENCE, EVEN IF AN AUTHORIZED REPRESENTATIVE OF BBS HAS BEEN ADVISED OF OR SHOULD HAVE KNOWLEDGE OF THE POSSIBILITY OF SUCH DAMAGES. YOU HERE BY ACKNOWLEDGE THAT THIS PARAGRAPH SHALL APPLY TO ALL CONTENT, MERCHANDISE AND SERVICESAVAILABLE THROUGH THE SITE. PRICES AND AVAILABILITY OF PRODUCTS ON THE SITE ARE SUBJECT TO CHANGE WITHOUT NOTICE. ERRORS WILL BE CORRECTED WHEN DISCOVERED, AND WE RESERVE THE RIGHT TO REVOKE ANY STATED OFFER AND TO CORRECT ANY ERRORS, INACCURACIES, OR OMISSIONS (NCLUDING AFTER AN ORDER HAS BEEN SUBMITTED).
The BBS trademarks, logos, and service marks (collectively the "Trademarks") displayed on the Site, including, without limitation, the Brightonbeautysupply logo, are registered and/or unregistered Trademarks of BBS. Nothing contained on the Site should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any Trademark displayed on the Site without the prior written consent of Brightonbeautysupply.com or such third party that may own the Trademarks displayed on the Site. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms and Conditions, is strictly prohibited.
We are not responsible for the content of any sites that may be linked to or from www.Brightonbeautysupply.com. These links are provided for your convenience only and you access them at your own risk. Any other websites accessed from the Site are independent from BBS, and BBS has no control over the content of those other websites. In addition, in no event shall any reference to any third party or third party product or service be construed as an approval or endorsement by BBS of that third party or of any product or service provided by a third party.
Use of Professional Items
At Brightonbeautysupply.com we have large verity of products for professional use and general use. BBS expects all customers who order professional use products to know how to use them. Brightonbeautysupply.com is NOT responsible for the outcome.Brightonbeautysupply.com reserves a right to ask for your professional license before approving your order.
For Rushed Delivery, orders received by 3 PM Eastern Time Monday to Friday will be processed that same day (for in-stock products only). Orders recieved after that time will be processed the next business day. If the product is backordered the customer will be notified.
For Standard and FREE Delivery please allow 1 to 4 business days to process an order and additional time in transit. Standard delivery orders will be processed in order they received. If the customer accepts promotional offers for free shipping during checkout please note that Brighton Beauty Supply reserves the right to cancel that offer on extremely large and heavy orders (rare). Orders placed on Friday, weekends or national holidays will be processed on Monday or the following business day. You can view your shipping rate by going to checkout and entering your billing and shipping information during the first step of checkout. You DO NOT have to place your order or enter your credit card number in order to view your shipping rate.
*We are unable to redirect orders once items have been dispatched. *We are unable to change destination address if the order was paid via Pay Pal or Google Account. *All orders that have been refused by consumer and returned back to our warehouse will be processed as regular return in which case shipping cost will be deducted from original payment. *Brighton Beauty Supply requires a signature for certain goods delivered. That decision is based on destination address, amount paid for an order or a shipping carrier’s requirements. If consumer was not available to sign for the package, delivered goods will be returned to our warehouse in which case consumer will be responsible for reshipping cost. If consumer decides to cancel that order shipping cost will be deducted from original payment. That applies to all orders including orders with promotional free shipping option. *Brighton Beauty Supply is not responsible for any delays caused by shipping carrier.
All BBS Consumers are responsible for submitting correct information, as to the nature of Billing and Shipping information. In case of providing, mistakenly or purposely, incorrect destination address package will be returned back to our facility and consumer will be responsible for original shipping fee (if order was eligible for free shipping option) and address correction fee. Those fees are to be determined at the moment of return and depend on destination point.
Due to order volume our inventory levels may vary. We do have an extensive inventory however there are times back orders occur. We will hold orders with back orders on them for a period up to 15 days while waiting to receive our shipment from our product suppliers. If for some reason we do not receive the back ordered item(s) through the manufacturer within the 15 day period we will cancel the back order and issue a credit for the charged item(s). At which point the customer will be notified by email or phone of the adjusted price of their order. We will then ship out the order with what we have on hand per customer request. We do NOT do separate shipments.
Brightonbeautysupply.com offer large selection of products online. Items from selected companies are sent directly from manufacturer. In this case customer will not receive any promotional gifts and/or free samples from Brightonbeautysupply.com
Cancellations or Shipping Changes
Once any order is placed it goes into our automated fulfillment system and is processed usually the same day. You may return the product under our return policy. Once you submit an order you can no longer change shipping or billing options. If you wish to change any provided information please contact our customer service.
Substitution and Typos
Brightonbeautysupply.com is not responsible for typos of price or description. We reserve the right to substitute a listed product for one of a different size. We will always make these substitutions on the side of the customer's best interest. We will always make it a better deal for the customer.
WE DO NOT CURRENTLY SHIP TO CANADA
PO, APO and FPO Boxes
All packages sent via US Postal Services. Orders will usually arrive within 14 business days (for in-stock items only).
Hawaii, Alaska and Puerto Rico
There are NO Flat rates or Promotional Free Shipping for shipments to Hawaii, Alaska and Puerto Rico, customers must pay shipping fees in full. There are times when our system lets customers apply promotional offers during checkout. Customers will be contacted via e-mail or by phone to collect additional shipping fees. Please refer to our Terms and Conditions.
Sorry, we currently do not accept international orders.
